What Is HIPAA?
HIPAA stands for the Health Insurance Portability and Accountability Act of 1996, which was enacted by Congress to protect sensitive patient data. The act contains a “Privacy Rule” and a “Security Rule,” which in turn protect the privacy, and set standards for the security, of electronic protected health information (“e-PHI”). Taken together, these rules establish national standards for how companies working with sensitive patient data must ensure that data’s confidentiality, availability and integrity.
What is HITECH?
HITECH stands for the Health Information Technology for Economic and Clinical Health Act, which was enacted as part of the American Recovery and Reinvestment Act of 2009. HITECH is a dramatic update of the HIPAA Security Rule that more clearly outlines the things that companies working with ePHI must be doing with that health data. It sets clear guidelines for proper interaction with health information, expands the liabilities of companies that are subject to oversight, increases fines for non-compliance and enables more stringent enforcement.
